Tutor Terms & Code of Conduct

01Acceptance, definitions and scope

These Tutor Terms & Conditions (“Terms”) form a binding agreement between the individual accepting them (“Tutor”, “you”) and the legal entity operating TutoriaGlobal.

They apply to tutor applications, verification, onboarding, profiles, training, student assignments, trial classes, paid Sessions, lesson reports, communications, recordings where enabled, payments and all related services.

• “Student” means a learner receiving Services, including a minor.
• “Parent” includes a parent, guardian or authorised adult account holder.
• “Session” means a class, assessment, demo, orientation or academic meeting.
• “Platform” includes the website, dashboard, approved video tools, authorised messaging channels and operational systems.

02Eligibility and legal capacity

You must be at least 18 years old, legally capable of contracting, and qualified and competent to teach the subjects, grades and curricula stated in your profile.

You must not apply or teach under another person’s identity. We may impose additional minimum qualifications, experience, language, device, background-check or location requirements for particular assignments.

03Nature of engagement

Unless a separate written employment agreement states otherwise, you provide tutoring services as an independent service provider and not as an employee, partner, agent or legal representative of TutoriaGlobal.

You control your accepted availability and professional teaching approach, subject to agreed schedules, curriculum requirements, safeguarding rules, quality standards and lawful operational instructions. You have no authority to bind TutoriaGlobal, promise refunds, change prices, accept money, issue official certificates or make public statements on our behalf.

The actual relationship will be determined by applicable law and the real working arrangement, not merely by a label.

04Application, verification and ongoing disclosure

• All information, documents and claims submitted must be complete, authentic and current — identity, age, address, qualifications, experience, references, employment history, curriculum expertise, language ability and availability.
• You authorise us to verify documents, contact references, conduct interviews, review sample classes and carry out lawful identity, qualification, criminal-record or safeguarding checks where available and appropriate. Verification does not guarantee assignments.
• You must promptly disclose any material change — loss or suspension of a licence, professional disciplinary action, a criminal charge or conviction relevant to teaching or safety, a safeguarding allegation, a conflict of interest, or an inability to meet an assignment.
• Providing false documents, concealing a material fact, or allowing another person to teach through your account is grounds for immediate suspension or termination and may be reported to the appropriate authorities.

05Legal compliance, permits and professional obligations

You must comply with laws, professional rules, school or examination-board requirements and tax obligations applicable where you live, work and deliver the Services.

If a jurisdiction requires a private-tutor permit, work authorisation, employer consent or professional registration, you must obtain and maintain it before teaching from or within that jurisdiction. Our acceptance of a profile is not legal advice and is not a representation that no permit is required.

06Profile, onboarding and training

• We may display a Tutor profile using approved information, photographs, qualifications, experience, languages, subjects, introductory video and teaching preferences. You must correct inaccuracies promptly.
• You must complete required orientation, safeguarding acknowledgement, platform training and demo evaluation before receiving assignments, and any refresher training reasonably required later.
• Login credentials and training materials are personal and confidential. You must not share assessments, answer keys, internal rubrics, pricing, parent leads or operational documents.

07Assignments and no guarantee of work

We may offer assignments based on student needs, subject expertise, availability, quality history, language, safeguarding and other legitimate factors. You may accept or decline before confirmation, but must honour an accepted assignment.

There is no guarantee of a minimum number of students, sessions, hours, income, renewal or continued assignment. Parent preference or a successful demo does not create an entitlement to future work. We may reassign a Student where required for availability, compatibility, quality, safety or complaint handling.

08Availability, scheduling and time zones

• Maintain accurate availability and verify each Session in the time zone stated in the confirmation. Tutors serving international families are responsible for daylight-saving changes and must not rely solely on informal chat messages.
• Do not accept overlapping commitments. A confirmed Session takes priority over avoidable commitments.
• Schedule changes must be made through approved systems or staff. You may not privately agree permanent timetable, package or fee changes with a Parent.

09Attendance, punctuality and cancellations

• Join the approved classroom at least five minutes before the scheduled start, with working audio, video where required, materials and a professional background. Remain available for the full Session.
• Where cancellation is unavoidable, notify us through the approved channel as early as possible and ordinarily at least 24 hours before the Session. You must not ask a Student to conceal a cancellation or mark attendance falsely.
• An unapproved absence, repeated lateness, early ending, personal multitasking, or a Session not delivered to the required standard may be unpaid and may result in reassignment, corrective action, suspension or termination.
• If the Student is absent, follow the attendance procedure and remain in the classroom for the required waiting period.

10Teaching standards and professional conduct

• Prepare age-appropriate lessons aligned with the agreed subject, curriculum, learning objective and Student level.
• Explain concepts patiently, adapt instruction, encourage questions and maintain a respectful learning environment.
• Do not teach while driving, in a noisy public place, under the influence of alcohol or drugs, or while engaged in unrelated work.
• Maintain professional dress, background, tone and camera conduct where video is used.
• Do not shame, threaten, intimidate, discriminate against, compare harshly, or use corporal-punishment language with a Student.
• Do not guarantee marks, admission, rank or examination success, and do not diagnose a learning or medical condition.

11Lesson preparation, reports and records

• Complete attendance, lesson notes, homework, learning objectives and parent-report inputs accurately within the deadline we specify, normally within 24 hours after the Session.
• Reports must be factual, constructive and specific. Do not copy generic statements, fabricate progress, conceal a missed Session, or use automated text without reviewing it for accuracy and appropriateness.
• Use only approved storage and systems for Student records. Personal notebooks must use minimal identifiers, be secured, and be destroyed or returned when no longer needed.

12Child safeguarding code and professional boundaries

Safeguarding is a condition of every assignment. A breach may result in immediate removal, preservation of evidence, reporting to parents or authorities, and termination.

• Keep every interaction educational, age-appropriate, transparent and capable of being reviewed.
• Do not request secrecy from a minor, or ask a Student to hide messages, gifts, meetings or conduct from a Parent or from us.
• Do not add or follow a Student on personal social media, use disappearing messages, or move communication to a secret or unapproved channel.
• Do not request or share personal photographs, home address, live location, identity documents, intimate information or unnecessary details about family life.
• Do not meet a minor Student physically, offer transport, enter their home, send gifts of material value, or arrange off-platform contact without written approval and verified parent involvement.
• Do not use sexualised, romantic, threatening, humiliating, discriminatory or otherwise inappropriate language, images, jokes, gestures or examples.
• If a Student discloses harm, abuse, self-harm or exploitation: listen calmly, do not promise secrecy, do not investigate, preserve relevant information, and report immediately through the designated safeguarding channel.

13Parent and student communications

• Use the Platform or authorised channels. Where direct messaging with a minor is operationally necessary, the Parent, guardian or an authorised representative must be included unless a formally approved system provides equivalent oversight.
• Keep messages limited to scheduling, lessons, assignments, progress and appropriate encouragement. Do not discuss your personal relationships, finances, politics or religion except where objectively required by the curriculum and handled neutrally.
• Do not ask a Parent for direct payment, sell unrelated products or services, negotiate a separate fee, or criticise our commercial terms. Refer billing and package questions to support.

14Session recording, observation and quality assurance

• Where permitted and notified, we may record, observe or review Sessions for safety, quality assurance, complaint investigation, coaching and service improvement. You consent to such authorised recording and monitoring as a condition of assignments where the feature is used.
• You must not make your own recording, screenshot, photograph, livestream or copy of a Student or Session unless we have given written approval and all required participant consents have been obtained.
• We may use Session observations, student outcomes, parent feedback, reports, attendance and policy compliance to evaluate quality and assignment suitability.

15Confidentiality and student data

• Student and Parent information is confidential. Use it only to provide the assigned Services and only through approved systems. Do not disclose it to family, friends, employers, other tutors, schools or social-media audiences.
• Collect only what is necessary. Do not retain payment information, identity documents, school login details or medical records unless expressly authorised for a legitimate purpose.
• Protect devices with passwords, updates and reasonable security; avoid shared or public devices; use headphones where conversations may be overheard; report any loss, unauthorised access or suspected data breach immediately.
• On reassignment or termination, stop access and securely delete or return Student information, subject to any lawful retention instruction. Confidentiality survives the end of the engagement.

16Platform security and approved tools

• Use your own account and approved video, messaging, storage and reporting tools. Do not share class links publicly, permit another person to observe, use unauthorised browser extensions, or introduce third-party bots without approval.
• You are responsible for a reliable device, internet connection, secure location and legitimate software. Report phishing, suspicious links or account takeover immediately.

17Academic integrity and responsible use of AI

• Support learning without completing assessed work, taking an examination, impersonating a Student, supplying leaked papers, fabricating citations or enabling plagiarism.
• AI tools may be used only where permitted by us, the Parent’s instructions, the school or examination rules and applicable privacy requirements. You remain professionally responsible for accuracy, bias, age-appropriateness and originality.
• Do not upload a Student’s name, image, voice, school details, work or assessment records into a public or unapproved AI service. Do not use an AI-generated lesson report or academic recommendation without meaningful human review.

18Intellectual property

• Our materials, branding, assessments, question banks, reports, training, processes, recordings and commissioned content remain owned or licensed by TutoriaGlobal. You receive a limited licence to use them only for authorised assignments.
• You retain ownership of teaching materials created independently before the engagement (“Pre-existing Materials”). By using them in a Session you grant us and the assigned Student a non-exclusive, worldwide, royalty-free licence to store, display and use them for the relevant educational Service and internal quality review.
• Materials specifically commissioned and paid for as a deliverable belong to TutoriaGlobal to the extent permitted by law, unless a written assignment states otherwise.
• Do not use content that infringes copyright, confidentiality or school restrictions, and do not publicly reuse identifiable Student work or Session extracts.

19Tutor fees, taxes and payments

The price a student pays is set by the student’s class band. TutoriaGlobal retains a platform fee of approximately 40% of that price, which funds student acquisition, payment processing, scheduling, support and safeguarding. Your payout per one-hour session is:

• Payment is made only for Sessions and approved work accurately recorded and verified under the applicable payment cycle. We may withhold a disputed item while attendance, quality, cancellation or fraud is reviewed, but undisputed verified amounts will not be withheld without reason.
• No payment is due for an unapproved absence, a falsified Session, a duplicate claim, material non-delivery, an unauthorised substitute, or work already included in another paid item.
• Applicable tax may be deducted at source. Unless a separate employment agreement applies, you are responsible for your own income tax, GST or other registration, returns, insurance and statutory obligations.
• You provide your own device, internet, electricity, teaching setup and ordinary materials. No expense is reimbursable unless approved in writing before it was incurred.

20Direct payments, non-circumvention and non-solicitation

• You must not request or accept direct payment, gifts in place of payment, cash, personal bank transfer, cryptocurrency or any other off-platform consideration from a Parent or Student introduced through TutoriaGlobal.
• During an active assignment and for 12 months after the last introduction or Session, you must not solicit, divert or privately accept tutoring work from a Parent or Student first introduced through us, except through an approved written transfer. This applies only to the extent permitted by applicable law and is not a general restriction on your profession or on unrelated tutoring work.
• You must not solicit our staff or active tutors to divert students, misuse lead information, or assist a Parent in avoiding platform fees.

21Quality review, complaints and cooperation

• We may review demo performance, Session quality, punctuality, engagement, reports, complaints, parent feedback and policy compliance. You agree to receive constructive feedback and complete reasonable corrective actions or refresher training.
• Quality evaluation should be fair and will not be based on unlawful discrimination or a single unverified complaint — though safeguarding may require immediate temporary action while facts are reviewed.
• You must cooperate promptly and honestly with a quality, payment, fraud, privacy or safeguarding review, including preserving relevant messages and attending a meeting.
• Do not contact a complainant or minor privately, retaliate, delete evidence, coach a Student, or discuss a confidential investigation publicly.
• Information may be shared with a Parent, school, payment provider, insurer, legal adviser, regulator, police or child-protection authority where reasonably necessary and lawful.

22Outside work, conflicts and equal treatment

• Unless separately restricted in writing, you may teach or work elsewhere, provided it does not create a scheduling conflict, misuse our information, compromise a Student, or involve solicitation of platform families.
• Disclose any close personal, financial or employment relationship with a Parent, Student, school or competing service that could affect impartiality or safety.
• Treat every Student, Parent, Tutor and staff member with dignity. Discrimination, harassment, bullying, retaliation, bribery, sexual misconduct, hate speech, threats and exploitation are prohibited.
• Report discriminatory or abusive requests rather than responding privately or retaliating.

23Representations and warranties

• You have the qualifications, experience, language skills and legal permissions represented in your application.
• Your teaching and materials will be accurate, lawful, professional and appropriate for the Student’s age and curriculum.
• You will comply with safeguarding, confidentiality, anti-harassment, academic-integrity and data-protection requirements.
• You will not infringe intellectual property, disclose confidential information or introduce malicious software.
• You are not subject to an undisclosed restriction that prevents you from accepting or performing an assignment.

24Publicity and tutor profile content

You grant TutoriaGlobal permission to use approved profile information, professional photograph, qualifications, introduction video and non-confidential teaching samples to present your profile and market the tutoring Service during the engagement. We will not knowingly misrepresent qualifications or use private Student content, and you may request correction of inaccurate profile information. Use in paid advertising, after termination, or beyond ordinary profile display follows a separate consent or written arrangement.

25Suspension, termination and handover

• We may remove you from an assignment immediately where necessary for safety, service continuity, parent request, quality, availability, conflict or investigation. Removal from one assignment does not necessarily determine fault.
• Either party may end the general engagement by giving reasonable written notice, ordinarily 15 days where active students require handover, unless a separate agreement states otherwise.
• Immediate suspension or termination may occur for safeguarding risk, serious misconduct, false documents, fraud, unlawful conduct, harassment, a confidentiality or data breach, direct payment, an unauthorised substitute, repeated absence, or deliberately inaccurate reporting.
• On the end of an assignment you must complete an orderly academic handover, return or delete confidential data, stop representing association with TutoriaGlobal, and submit accurate final attendance and payment claims by the stated deadline.
• We will pay undisputed verified amounts due for completed authorised work. Clauses on confidentiality, data, intellectual property, solicitation, accrued payments, investigations, liability and disputes survive where their nature requires.

26Indemnity and limitation of liability

To the extent permitted by law, you are responsible for direct, documented loss reasonably caused by your fraud, wilful misconduct, unlawful disclosure of Student data, infringement of third-party rights, unauthorised direct collection of fees, or serious breach of safeguarding obligations. Any recovery will be proportionate and subject to due process.

To the maximum extent permitted by law, TutoriaGlobal is not liable for indirect, incidental or consequential loss; expected income from unassigned or cancelled future work; third-party outages; or loss caused by your device, connection, tax position or breach. Our aggregate liability arising from a specific assignment will not exceed the tutor fees paid or payable for that assignment during the preceding three months.

Nothing excludes liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any obligation that cannot lawfully be limited.

27Service changes, force majeure and changes to these Terms

• We may change systems, reporting formats, quality processes, communication tools, rates for future assignments, policies or service features. A confirmed rate will not be changed retrospectively for completed authorised work.
• Neither party is responsible for delay caused by events beyond reasonable control, including major power or internet failure, natural disaster, public emergency, war, civil disturbance, government action, epidemic, or a platform-wide outage.
• We may update these Terms for legal, safety, operational or service reasons. The version and effective date will be displayed here, and material changes will be notified where reasonably practicable. Continuing to accept new assignments after the effective date constitutes acceptance; existing payment rights for completed work are not removed retrospectively.

28Governing law, disputes and general provisions

These Terms are governed by the laws of India. The parties should first attempt in good faith to resolve a dispute through written notice and management discussion. Subject to any mandatory forum or remedy, the courts identified in that jurisdiction will have jurisdiction.

• If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary and the remainder continues.
• A failure to enforce a provision is not a waiver.
• You may not assign or subcontract an assignment, permit a substitute Tutor, or transfer your account without prior written approval. We may assign these Terms as part of a lawful restructuring, merger, sale or transfer of business.
• These Terms and incorporated documents form the agreement concerning the tutor relationship. Electronic records and acceptance may be used as evidence to the extent permitted by law.
